Lieutenant Colonel Novak Babic, as well as judge jurors, Lieutenant Colonel Ratomir-Du-kanac, Colonel Tomislav Karapandza and Lieutenant Colonel Miroslav Nemet, as members of the bar, with clerk GL /expansion unknown/ serving in the Yugoslav People's Army /JNA/ Persa Milosevic -- in the case against: The accused Marko FILKOVIC known as "Kinez" /the Chinaman/, a, civilian from Borovo Naselje, for the criminal offence described in Item I/1, armed rebellion pursuant to Article 124, Para 2 of and as co perpetrator with Damir SARADJEN under Item II/1 and 2 and as co-perpetrator with Zdenko STEFANCIC and Mira DUNATOV, with actions described in Item II/3 and 4; The accused Zdenko STEFANCIC known as "Plavi 5", a civilian from Borovo Selo, for the criminal offence pursuant to Article 24, Para. 2 of the KZ of the SFRY, described in Item I/2, and the criminal offence of war crime against the civilian population pursuant to Article 142, Para.1 of the KZ of the SFRY, as cooperator with Marko FILKOVIC, under Item II/3 and 4 and with actions under Item 5,6,7 and 8, as co-perpetrator with Mira DUNATOV; The accused Mira DUNATOV, a civilian, from Vukovar, for the criminal offence of armed rebellion pursuant to Article 124, Para. 1 of the KZ of the SFRY, under Item I/3 and the criminal offence of war crime against the civilian population pursuant to Article 142, Para. I of the KZ of the SFRY, under Item II/3,4,5,6,7 and 8 and under Item II/5,6,7 and 8, as co-perpetrator with Zdenko STEFANCIC; and The accused Damir SARADJEN, a civilian from Borovo Naselje, for the criminal offence of armed rebellion pursuant to Article 124 Para. 2 of the KZ of the SFRY, under Item I/4 and for the criminal offence of war crime against the civilian population pursuant to Article 142. Para. I of the KZ of the SFRY, as co-perpetrator with Marko FILKOVIC, and pursuant to Item II/1 and 2 according to the indictment of the Military Prosecutor in VP 2082 Belgrade, IVIK Number 260/92 of 01.04. 1992, with changes made at the main hearing on 08.07.1992, after the oral, main and public hearing held on 29 and 30.06.1992 and 01,02,03,06,08,10 and 14.07.1992, in the presence of the counsel for the prosecution Major Milan RANIC, the accused Marko FILKOVIC and his defence lawyer Dr. Vojislav Vukcevic, the accused Zdenko STEFANCIC and his defence lawyer Srdja Popovic, the accused Mira DUNATOV and her defence lawyer Dr. Vojislav Vukcevic and the accused Damir SARADJEN and his defence lawyer Milan Vukovic, reached on 14.07.1992 and on the same day publicly announced in the presence of the parties this. On the basis of the investigation report, photographic documentation and the post-mortem report for ***** ****** , the court established that shotgun wounds were found on the body of the above-named in the region of the head, around the temples on both sides, both lower legs, the right forearm, the right knee, the left lower leg and the right foot, while there were many fractures in the crown of the skull. It was a violent death and was caused by the destruction of brain tissue. These injuries were caused by bullets from a hand-held firearm.
